SIMONSON PAYMENT PLAN TERMS AND CONDITIONS
The Simonson payment plan is really what is sometimes called a "Layaway" Plan. A Layaway plan is one where you pay installments on the item you want, and the item is reserved for you and kept by the seller until fully paid for. In other words, when your payment plan is approved, we will take the art off the market and reserve it for you, and we will hold it for you until it is fully paid for. We do not send out the artwork until it is fully paid for.
AVAILABLE ON MOST ARTWORKS, BUT NOT ON SALE ITEMS
The Simonson Payment Plan is available on almost all Simonson artworks priced at $125 or more. Any artwork on the website which has a "Payment Plan" button appearing by it is available via the payment plan (unless that work has already been sold). However, sale items (artworks being offered at sale prices or special introductory prices) may not be purchased on the payment plan, except at the regular retail price.
NO INTEREST
The Simonson Payment Plan charges no interest. The price of the artwork and the shipping charge are added together and divided by the number of months of the payment plan, and that's how much you pay each month. (This will be calculated automatically based on the choices you make on the "Setting up your Customized Payment Plan" page.)
CREDIT CARD OR CHECK/MONEY ORDER
You can make monthly payments by sending the Simonson Studio a monthly check, or by authorizing us to make monthly charges to your credit card. We suggest the latter because it's much easier for you and for us--neither of us has to be concerned with the check arriving on time each month. (If you are paying by check, be aware that we will charge a Late Fee of $10.00 if the check arrives more than 3 days after the due date.)
MONTHLY STATEMENT
Each month, after the payment has been received or the credit card charge has been made, the Simonson Studio will send you a monthly statement showing how much you've paid and how much remains to be paid, so you'll always know the status of your Payment Plan.
THE PLAN CAN BE FLEXIBLE--BUT COMMUNICATION IS VITAL
The Payment Plan you agree to is a kind of contract, but it's a flexible contract. Of course you can always make larger payments and get your artwork up on your wall that much sooner. Or conversely, you may run into unexpected circumstances and need to change your payment plan--smaller payments for a couple of months, for instance. We can accommodate most requests of this kind--but of course you must contact us and make the request as quickly as possible. Our goal is to make sure you get the art you want. If the payment plan needs to be restructured in any way, that's almost always possible. But the most important thing is to stay in touch with us. We can't help you complete your payment plan if you need our assistance but don't let us know about it. So please contact us if you ever need to change the terms of your payment plan. (See "Nonpayment and Failure to Communicate" below.)
CANCELLATION
If you have initiated a payment plan and for some reason, after having made one or more payments, you wish to cancel the payment plan and receive a refund on payments already made, you may do so, with the following conditions:
- (a) You must notify us immediately so that we can put the art back on the market.
- (b) You will be charged a fee of 15 percent of the total payments already received from you on the artwork, as a service fee and as compensation for our having kept the art off the market for that period of time.
- (c) The remaining refund due you will be paid in monthly installments, in the same amounts as it was paid by you to us (minus the 15 percent cancellation service fee). We will mail you the first refund payment no more than 30 days after we have received notification from you of your wish to cancel the payment plan. Should there be more than 1 monthly payment due you, succeeding payments will be sent to you at 1-month intervals until the amount due you has been paid off. (Refund payments will be made by check only.)
NONPAYMENT AND FAILURE TO COMMUNICATE
When you can't make a monthly installment payment, you must contact us as quickly as possible. If we do not receive payment and we do not hear from you, we will make every effort to contact you to resolve the situation. But if we receive no payment or communication from you for 60 consecutive days, you will be in default and the payment plan will be terminated. We will then put the reserved artwork back on the market, and you will forfeit whatever payments you have already made. To repeat: When you make no payments nor communicate with us for a period of 60 days or longer, the art will not be yours, and no refunds will be made.
